Terms and conditions

Terms and conditions for the provision of services by electronic means. In force from: ⟨DO UZUPEŁNIENIA: date⟩

§1. General provisions

1. These terms set out the rules for using the website ⟨DO UZUPEŁNIENIA: website address⟩ and the rules for providing services by electronic means.

2. The service provider is ⟨DO UZUPEŁNIENIA: registered company name⟩, ⟨DO UZUPEŁNIENIA: address⟩, VAT ID (NIP) ⟨DO UZUPEŁNIENIA⟩, statistical number (REGON) ⟨DO UZUPEŁNIENIA⟩, e-mail ⟨DO UZUPEŁNIENIA⟩, phone +48 696 300 627.

3. These terms are made available free of charge, in a form that allows them to be downloaded, saved and printed.

§2. Services provided by electronic means

1. The service provider provides the following services by electronic means:

  • making available information about the training offer, trips and prices,
  • enabling contact through the contact form or by e-mail.

2. These services are free of charge. The site does not sell online — bookings for courses and trips are made by individual arrangement.

3. The information published on the site, including the price list, does not constitute an offer within the meaning of Article 66 §1 of the Polish Civil Code (Kodeks cywilny), but an invitation to conclude a contract.

§3. Technical requirements

Using the site requires a device with internet access and an up-to-date web browser with JavaScript enabled. Using the contact form requires an active e-mail address.

§4. Prohibition on supplying unlawful content

The user undertakes not to supply content of an unlawful nature, in particular content infringing the personal rights or copyright of third parties.

§5. Conditions for taking part in training

1. Taking part in a diving course requires reaching the age required for the course in question, submitting a health declaration and holding the required prerequisite certifications.

2. Participants under 18 may take part in training only with the written consent of a legal guardian.

3. The instructor has the right to refuse to allow a participant to dive if their state of health, their behaviour or the conditions at the dive site put safety at risk. The instructor’s decision on matters of safety is final.

4. ⟨DO UZUPEŁNIENIA: payment terms, deposits, cancellation and rescheduling of course dates⟩

§6. Complaints

1. Complaints concerning services provided by electronic means may be submitted to the e-mail address ⟨DO UZUPEŁNIENIA⟩ or in writing to the address of the registered office.

2. A complaint should include contact details, a description of the problem and the outcome expected.

3. The service provider considers a complaint within 14 days of receiving it and communicates the outcome in the same form in which the complaint was submitted.

§7. Personal data

The rules for processing personal data are set out in the privacy policy.

§8. Final provisions

1. Matters not governed by these terms are subject to Polish law, in particular the Polish Civil Code (Kodeks cywilny), the Polish Act on Providing Services by Electronic Means (ustawa o świadczeniu usług drogą elektroniczną) and the Polish Consumer Rights Act (ustawa o prawach konsumenta).

2. The service provider reserves the right to amend these terms. Amendments take effect on the day they are published on the site.

⟨UWAGA: these terms have been prepared as a starting point and require review by a lawyer before publication — in particular §5 as regards payment terms and withdrawal from the contract, and the question of Article 38 of the Polish Consumer Rights Act (ustawa o prawach konsumenta) in relation to leisure services booked for a specified date.⟩
